Welcome to Plantolivar’s Terms and Conditions of Service. By using our turnkey olive grove planting services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.
1. Scope of Service
Plantolivar offers a complete turnkey olive grove planting service, which includes:
• Planning and Feasibility Study: analysis of the terrain, selection of the most suitable olive tree varieties, and definition of planting spacing.
• GPS-guided mechanized planting: using advanced technology to ensure maximum precision in plant alignment and spacing.
• Supply and Placement of Materials: includes olive grove plant, stake, metal posts, metal wire, and drip irrigation tubing.
• Fertigation: injection of water and fertilizers (liquid or solid) to optimize the initial development of plants.
• Technical Support: Assistance and guidance during the initial phases of the project.
2. Budgeting and Contracting
2.1. Customized Budgets: Each project is unique, and Plantolivar is committed to providing detailed and personalized budgets, tailored to the specific needs of each client and the characteristics of the land.
2.2. Acceptance of the Budget: the contracting of services is formalized after the client’s express acceptance of the budget, which must be accompanied by their signature, for the awarding and respective provision of services.
2.3. Payment Terms: Payment terms will be established in the contract and may include an initial advance payment and installments according to the project’s progress.
3. Plantolivar’s Responsibilities
• To ensure the execution of services with the utmost diligence and professionalism, using state-of-the-art equipment and techniques.
• Guarantee the quality of the materials supplied and installed.
• Meet the agreed deadlines for project execution, except in situations of force majeure or adverse weather conditions that may compromise the safety or quality of the work.
• To provide technical support and answer questions related to the service provided.
4. Customer Responsibilities
• Provide all necessary information about the site and the project objectives.
• Ensure adequate access to the planting site for the Plantolivar team and equipment.
• Make payments in accordance with the terms set out in the contract.
• Obtain the necessary licenses and permits for planting, if applicable.
5. Guarantees
A Plantolivar garante a qualidade da plantação e dos materiais utilizados. Quaisquer anomalias ou defeitos decorrentes da execução do serviço ou da qualidaPlantolivar guarantees the quality of the planting and the materials used. Any anomalies or defects resulting from the execution of the service or the quality of the materials, which are reported within the period established in the contract, will be verified and corrected if confirmed by Plantolivar.ade dos materiais, que sejam comunicados dentro do período estabelecido no contrato, serão verificados e corrigidos caso confirmação pela Plantolivar.
6. Force Majeure
Plantolivar will not be liable for delays or failures in the execution of services resulting from force majeure events, including, but not limited to, extreme weather conditions, natural disasters, strikes, pandemics, or other unforeseeable and uncontrollable circumstances that prevent normal operation.
7. Conflict Resolution
Any dispute arising from the interpretation or execution of this contract shall be resolved by mutual agreement between the parties. If an agreement is not possible, the parties shall submit the dispute to the competent court of Ourém, Portugal, expressly waiving any other jurisdiction.
8. Changes to the Terms of Service
Plantolivar reserves the right to change these Terms of Service at any time. Changes will be posted on the website and will take effect immediately upon posting. Continued use of our services after the posting of changes constitutes acceptance of the new terms.
